Terms of Service

Acceptance

By accessing or using YUSR AI at app.yusr.co.in, you agree to be bound by these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms.

Description of service

YUSR AI is a multi tenant WhatsApp Business CRM platform for managing customer conversations, broadcast messaging, contacts, and AI powered features through the WhatsApp Business API.

Your use of WhatsApp features through YUSR is additionally governed by the WhatsApp Business Policy and Meta Platform Terms.

Eligibility

You must be at least 18 years old and capable of forming a legally binding agreement. The Service is for business use only, not personal or consumer messaging.

Account responsibilities

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Accept responsibility for all activity under your account
• Notify us immediately of any unauthorized use at support@yusr.co.in

WhatsApp compliance

You agree to comply with all WhatsApp Business Policies, including:

• Opt in consent: obtain explicit opt in before sending any business initiated message
• Prohibited content: do not send content related to illegal drugs, weapons, adult content, gambling where prohibited, or any category prohibited by WhatsApp's Commerce Policy
• Spam prevention: do not send unsolicited messages or engage in behavior that violates WhatsApp's spam policies
• Template compliance: use only approved templates for business initiated conversations outside the 24 hour service window

Acceptable use

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm any person
• Send spam, phishing messages, or deceptive content
• Attempt unauthorized access to any system or data
• Reverse engineer or decompile the Service
• Resell or sublicense the Service without written authorization
• Overload or disrupt our infrastructure

Subscription and billing

• Subscriptions begin with a free trial period as specified at signup
• Payments are processed by Razorpay. By subscribing, you authorize recurring charges
• Subscription fees are not refundable unless required by applicable law
• Pricing changes are communicated with 30 days notice to active subscribers
• Failure to pay results in a grace period, after which access may be suspended

YUSR's subscription fee covers platform access only. WhatsApp message charges levied by Meta are separate and based on your message volume.

Data ownership

You retain ownership of all data you input into YUSR AI: contacts, message history, and business information. YUSR acts as a data processor on your behalf, with a limited license to process and store this data solely to provide the Service.

Intellectual property

The YUSR AI platform, including its design, code, branding, and documentation, is owned by YUSR and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without written permission.

Service availability

We strive for high availability but do not guarantee uninterrupted service. We are not liable for outages caused by Meta's WhatsApp API, infrastructure providers, or circumstances beyond our control. Scheduled maintenance will be communicated in advance.

Limitation of liability

YUSR's total liability for any claim shall not exceed the amount you paid in the 3 months preceding the claim. YUSR is not liable for indirect, incidental, or consequential damages, or for damages arising from your violation of WhatsApp's policies resulting in account suspension or ban.

Indemnification

You agree to indemnify and hold harmless YUSR and its officers from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or violation of any third party rights including WhatsApp's policies.

Termination

Either party may terminate at any time. Cancel through Settings → Billing in your account. We may suspend or terminate your access for Terms or policy violations. Upon termination, your data is retained for 90 days then permanently deleted, unless you request earlier deletion via our Data Deletion page.

Governing law

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of India.
